Individuals

Your land, without unpleasant surprises.

Buying, building on, registering or dividing a plot of land: these are often once-in-a-lifetime decisions. Here is what to check at each stage, and what a surveying engineer can do for you.

Your situation

Six situations, six procedures.

Buying land

Know exactly what you are buying

Land may be registered (land title), in the process of registration (registration application) or held under a deed, such as a melkia (customary ownership deed). The level of security is not the same.

  • Check the legal status of the land and request a recent certificate of ownership for titled land
  • Compare the actual boundaries on the ground with the title plan
  • Identify missing boundary markers, encroachments and visible easements
  • Consult the planning rules that apply before signing

Building

Prepare your permit application

Your architect needs an accurate plan of the land to design the project and put together the building permit application.

  • Topographic spot-height plan of the land and its surroundings
  • Setting-out of the building on the land before works begin
  • As-built survey at the end of the works, if required
  • Updating the land title after construction

Registering

From melkia to land title

Registration turns a right based on a deed into a land title, which the law describes as final and unchallengeable. It is the best protection for you and your heirs.

  • Filing a registration application with the land registry
  • Adversarial boundary marking of the land, in the presence of neighbouring owners
  • Preparation of the technical file by the surveying engineer
  • Legal notice, objection period, then issue of the title if no objection remains

Inheritance and division

Divide land between heirs or partners

Dividing titled land requires a plot division plan and, depending on the location of the land, prior administrative authorisation (Law No. 25-90, as amended by Law No. 34-21).

  • Feasibility study of the division under the planning rules
  • Plot division plan drawn up according to the agreement between the parties
  • Preparation of the authorisation file when required
  • Issue of separate titles for each share

Apartments and co-ownership

Obtain a title for each apartment

In a building, each apartment can have its own land title, provided the building is placed under the co-ownership regime.

  • Survey of the building and floor area calculations
  • Co-ownership plans: private and common parts
  • Technical file for issuing titles per unit

Boundaries and neighbours

Find the boundaries of your property

Missing boundary markers, a wall built in the wrong place, a disagreement with a neighbour: the first step is to measure, based on the official documents.

  • Reinstatement of boundary markers on titled land
  • Check survey of boundaries and buildings
  • Adversarial plan that can serve as a basis for an amicable agreement or be produced in court

Frequently asked questions

What individuals ask us.

These answers are general. Your particular situation always deserves a review of your documents.

What is the difference between a melkia and a land title?

A melkia is a deed drawn up by adouls (notaries under Islamic law) that establishes ownership on the basis of witness statements. It can be challenged. A land title is issued by the land registry at the end of the registration procedure: the law describes it as final and unchallengeable, and it comes with a precise plan.

When you buy untitled land, it is wise to assess the risks and, if possible, to start its registration.

Is my land title plan enough to know my boundaries?

The title plan is authoritative, but it has to be found again on the ground: boundary markers may have disappeared or a wall may have been misplaced. A boundary marker reinstatement or a check survey makes it possible to verify that reality matches the plan.

My neighbour has built on my land. What should I do?

Start by having a plan drawn up that precisely locates the title boundaries and the construction. This objective document often makes it possible to reach an agreement; failing that, it can be produced before the court, which may also appoint an expert.

How much does boundary marking or a topographic plan cost?

It depends on the area, the terrain, the procedure and the distance. We draw up a written quote after reviewing your documents; it separates our fees from the charges collected by the authorities.
