Subdivision and plot division: from the first survey to the title for each lot

Dividing land, between heirs or to sell building plots, involves plans, authorisations and boundary markers. We take charge of the surveying part, from the initial survey to the splitting of the titles.

Subdivision or plot division

Two procedures, depending on what the lots are for.

Law No. 25-90 on subdivisions, housing groups and plot divisions, as amended and supplemented by Law No. 34-21 (Official Bulletin No. 7533 of 10 August 2026), distinguishes two cases.

Subdivision (lotissement, التجزئة العقارية): the division of land into two or more lots intended for building. It requires a subdivision authorisation issued by the president of the municipality, for land that is registered or undergoing registration without objection, with roads and utility networks. See the guide Creating a subdivision after Law 34-21.

Plot division (morcellement, تقسيم العقارات): the division into lots not intended for building, often a partition between heirs. In the areas covered by Article 58 (urban municipalities, delimited centres and their peripheral areas, areas covered by an approved urban planning document), a plot division authorisation is required; it is deemed granted after 30 days without a reply. See the guide Inheriting land and dividing it.

Before any plan, check what the urban planning document allows: minimum area, buildable zone or not. The guide Development plan, zoning, Taamir explains where to find these rules, and the What document do I need? tool points you to the right procedure.

Heirs

Dividing inherited land

The heirs are joint owners: each has a share, nobody has a plot. The plot division plan turns these shares into lots, with access for each.

  • Calculation of the shares in m² with the inheritance tool
  • Division proposals that respect the shares and the planning rules
  • Plot division plan incorporated by the adoul or the notary

Creating a subdivision

Building plots, roads, utility networks: the surveyor draws up the topographic plan on which the architect designs the project (Article 14), then follows the land through to the titles.

  • Topographic plan for the authorisation file
  • Setting-out of the roads and lots
  • Site coordination and as-built survey

Working on a reliable base

A plan tied to Lambert and to elevation, with the boundary markers, the neighbouring titles and the relief: the basis for design and for roads and utilities studies.

How it works

From the study of the land to the titles of the lots.

A simple plot division does not go through all these steps: the quote specifies those that concern you.

  1. Review of the file

Land title or registration application, certificate of ownership, planning information note: we check whether it is a subdivision or a plot division and what the planning rules allow.

  2. Initial survey

Check of the boundary markers against the title plan, relief, buildings, existing roads and networks, neighbouring titles, tied to Lambert coordinates.

  3. Plot division plan or topographic plan

For a plot division: location, boundaries and area of each lot. For a subdivision: the topographic plan for the authorisation file, on which the architect draws up the layout plan.

  4. Setting-out

Once the authorisation has been obtained, the road centrelines, lots and structures are transferred onto the ground, with levelling benchmarks.

  5. Site coordination

For a subdivision, the developer may appoint us as site coordinator (see below): measured checks during the works, then an as-built plan.

  6. Boundary marking and splitting of titles

Boundary marking of the lots, topographic plan drawn up after boundary marking (Article 32), technical file submitted to the cadastre service, then application to the land registry for a title per lot.

Law No. 34-21

The “surveying engineer” site coordinator.

The new Article 17 of Law No. 25-90 speaks of a site coordinator (coordonnateur de chantier, منسق الورش) and expressly mentions the surveying engineer (ingénieur topographe) among the professionals the developer may appoint. In our reading, this is not the only possible profile. The role: to monitor the execution of the works in accordance with the documents on the basis of which the authorisation was issued.

At the end of the works, the declaration of completion must be accompanied by a certificate signed by the coordinator certifying that the works comply (Article 22). The surveying engineer is now among the persons summoned to the provisional acceptance (Article 24). The coordinator therefore commits their signature.

For a surveying engineer (ingénieur géomètre-topographe), this role relies on measured checks:

  • Setting-out of the roads and lots in relation to the authorised plan
  • Levels and gradients of the carriageways and networks
  • Position of manholes and boundary markers
  • As-built plan of the completed works, examined together with the site logbook

Some provisions of Law No. 34-21 await implementing texts. The subdivision guide points them out; only the Arabic text of the Official Bulletin is authoritative.

Deliverables and documents

What you receive, what you need to provide.

Plans
Spot-height topographic plan, plot division plan or subdivision plan, setting-out plans, as-built plan, signed by the surveying engineer (PDF).
Digital files
DWG/DXF and lists of coordinates in Lambert, for the architect and the engineering consultancy.
For the titles
Boundary marking report, plan drawn up after boundary marking and technical file submitted to the cadastre service, which checks it and transfers it onto the cadastral map.
To provide
Title or registration application number, recent certificate of ownership, planning information note if you have it, agreement of the parties on the division (plot division), authorisation and authorised plans (subdivision).

Equipment, timescales, cost

What makes the timescale and the price vary.

We work with GNSS and the total station; the drone can be used for the initial survey when the extent of the land warrants it. The precision depends on the tie-in to geodetic points, the condition of the existing boundary markers and the density of points surveyed.

The cost and time of our work depend on the area, the relief, the number of lots, the condition of the boundary markers and, for a subdivision, the duration of the works. We do not publish rates (see our fees).

The timescales of the municipality, the urban agency, the cadastre and the land registry do not depend on us. For a subdivision, remember above all this rule: no lot may be sold, let or divided before provisional acceptance (Article 33).

Frequently asked questions

What we are asked.

Is dividing land between heirs a subdivision?

Only if the lots are intended for building. Otherwise, it is a plot division, subject to authorisation in the areas covered by Article 58. Note: Article 60 makes an application for plot division inadmissible in a buildable zone, where the operation falls under subdivision.

Can land held under a melkia be subdivided?

No. The application for a subdivision authorisation is inadmissible if the land is neither registered nor undergoing registration without objection (Article 5). Land registration must be started first.

Can I sell lots before the works are finished?

No. Deeds of transfer, letting or partition may only be executed after provisional acceptance (Article 33), and each irregular sale is a separate offence.

When are the titles of the lots created?

The subdivision is entered on the title after the topographic plan drawn up after boundary marking and the provisional acceptance report have been filed (Article 32). The developer then applies for a title per lot. For a plot division, after the boundary marking of the lots and the check of the technical file by the cadastre, the land registrar establishes a separate title and plan for each lot (1913 dahir, Article 54).

How can I be sure that each heir gets their share?

The inheritance tool gives each person's share in m². We then propose a division that respects these areas, access to each lot and the minimum area of the zone. The agreement of the heirs remains essential.
